Joshua D. Glatter’s practice centers on corporate disputes and commercial litigation, as well as insurance defense matters. Josh has been practicing litigation for over 30 years. He has worked on matters that include securities fraud, business divorces, corporate governance disputes, employment litigation, civil RICO, real estate litigation, and class action prosecution and defense. Josh has worked on matters in federal and state courts nationwide. He is adept at all phases of litigation, from initial pre-suit investigation through settlements and appeals.
Josh also has over a decade’s worth of experience representing victims of international terrorism against foreign financial institutions. Josh served on the plaintiff’s trial team in the first civil lawsuit under the federal Anti-Terrorism Act against a financial institution to ever proceed to a jury trial. In 2014, following a six-week jury trial garnering international media attention, the jury returned a verdict for the plaintiffs, holding the defendant – the Kingdom of Jordan’s largest bank – liable for injuries to U.S. nationals and their families that resulted from 24 attacks attributable to Hamas. Josh and his colleagues were awarded Public Justice’s Trial Lawyers of the Year award.

Josh was also principal brief author in Alessi v. Beracha, a case brought on behalf of “odd lot” investors which resulted in significant favorable decisions of first impression from Delaware state and federal courts concerning pre-emption under the Securities Litigation Uniform Standards Act, and the absence of bright line “price-and-structure” rules. In 2016 Josh served on the trial team in a complex oil-and-gas investment dispute, with the team winning a “Top 20” Nevada verdicts award.

Josh received his law degree from the University of Pennsylvania Law School. After graduating from law school, Josh served as a law clerk to the Hon. Tina L. Brozman (dec.), former Chief Judge of the United States Bankruptcy Court for the Southern District of New York. He thereafter was associated with prominent firms in New York, being elevated to partner and senior counsel before joining Miller Leiby.
Josh has co-authored two articles concerning ERISA fiduciary obligations for claims administrators and has also published several online articles addressing legal fraud risks, national security issues, changes to New York State’s LLC statute to combat money laundering risks, and consumer fraud matters.
